PART FOUR: TERMS OF USE

Section 4.1: User Eligibility and Account Registration

To use Trevia services, you must meet specific eligibility criteria. You represent that you are at least thirteen years old, with users under eighteen having parental consent for general services and users under eighteen restricted from financial services. You have legal capacity to enter into binding agreements. If representing a business, you have authority to bind that organization.

During account registration, you provide accurate and complete information. You maintain confidentiality of your password and do not share your account with other people. You update your account information when details change. You notify us immediately of unauthorized account access. You remain responsible for all activity on your account.

Trevia maintains accounts securely. We never request your password through email or support channels. We protect passwords using industry-standard encryption. We delete your account upon request. We respect your privacy per our privacy policy.

Section 4.2: User Responsibilities and Conduct Requirements

You agree to use Trevia services lawfully and responsibly. You comply with all applicable laws and regulations in your jurisdiction. You do not use services while impaired or unable to operate a vehicle safely. You do not engage in fraudulent transactions. You do not harass, threaten, abuse, or disrespect other users. You do not disrupt services for other users. You do not attempt to breach security or gain unauthorized access.

For drivers using Trevia Drive, specific responsibilities apply. Your vehicle must be in safe operating condition before charging sessions. You must have a valid driver's license. You must comply with all traffic laws while driving to chargers. You must follow rules established at charger locations. You assume responsibility for your vehicle's safety and your personal safety. Do not use the application while actively driving.

For charging operators providing chargers on our platform, you must ensure chargers are safe and functional. Electrical systems must comply with safety standards. You provide accurate and current charger specifications. You maintain chargers in good working order. You promptly update charger availability and status. You respond to user issues and complaints.

Payment obligations require you to pay for services you use. You authorize charges to your selected payment method or Trevia Wallet. You keep payment information current. You do not dispute legitimate charges. You reimburse Trevia for invalid chargebacks including associated fees of five hundred rupees.

Section 4.3: Prohibited Activities and Enforcement

Trevia services cannot be used for fraudulent, illegal, or abusive purposes. You cannot create false bookings or sessions. You cannot use stolen or unauthorized payment methods. You cannot attempt to dispute legitimate charges. You cannot use another person's account. You cannot attempt multiple bookings to circumvent limitations.

Harassment and abusive behavior are strictly prohibited. You cannot threaten, abuse, insult, or disrespect users or staff. You cannot make false complaints or accusations. You cannot share personal information without consent. You cannot engage in cyberbullying or defamation.

Technical abuse of our systems is forbidden. You cannot attempt to breach security or hack accounts. You cannot conduct denial-of-service attacks. You cannot reverse engineer our software. You cannot scrape data without permission. You cannot use automated bots or systems without authorization.

Misrepresentation of identity or information is not permitted. You cannot use fake identity or profile. You cannot impersonate others. You cannot provide false charger specifications. You cannot write false reviews or manipulate ratings.

Illegal activity is absolutely prohibited. You cannot use services for drug trafficking, money laundering, weapon trafficking, or prostitution. You cannot engage in any other illegal activity.

If you violate these rules, we may warn you for first offenses. We may suspend your account for repeated violations. We may permanently ban you from services. We may report illegal activity to law enforcement. We may pursue legal action to recover damages. We may refuse to provide services in the future.

Section 4.4: Intellectual Property Rights

All intellectual property created by Trevia remains our exclusive property. This includes our logo and branding, software code and algorithms, website and application layout and structure, graphics and animations, databases and data models, and documentation.

You cannot copy, reproduce, or distribute our intellectual property. You cannot create derivative works or modifications. You cannot use our intellectual property for commercial purposes. You cannot claim ownership of our content. You cannot reverse engineer our technology.

You retain ownership of information you provide to us. You retain ownership of photos you upload. You retain ownership of reviews and ratings you write. You grant Trevia a license to display your content in our services. You grant us permission to use your feedback to improve services. You allow us to share anonymized data derived from your information.

Section 4.5: Trevia Wallet System

Trevia operates an internal digital wallet system that allows users to add funds and use wallet balance to pay for EV charging sessions. Users may add funds to their Trevia Wallet through supported payment methods including debit cards, credit cards, UPI, and digital wallets. Wallet balance can be used to pay for any charging session booked through the Trevia platform.

Payments through the Trevia Wallet system are processed through Trevia's internal payment gateway integrations with Razorpay or Paytm. Trevia Wallet funds are stored securely in accordance with PCI DSS compliance requirements. Users maintain sole responsibility for their wallet account security and password confidentiality.

Trevia Wallet balances do not accumulate interest and are not considered deposits or stored value. Unused wallet balances may be refunded upon account deletion, subject to any applicable fees or legal holds. Trevia reserves the right to modify wallet terms with thirty days' notice to users.

Section 4.6: Payment Terms and Billing

Trevia displays current pricing for services, though prices may change without notice. When you book a charger, we show you the current rate before you complete your booking. You review the total cost before charging begins. You accept charges by initiating the charging session.

Your billing includes the charger operator's base fee, transaction processing fees ranging from one to two percent, applicable taxes including GST, and any dynamic pricing adjustments. Your billing does not include parking fees at charger locations, vehicle damage or repairs, or traffic violations incurred at charger sites.

We accept multiple payment methods including debit and credit cards of major brands, UPI through popular applications, digital wallets, and bank transfers via NEFT. Payments are processed through Razorpay primarily or Paytm as backup. Users may also use Trevia Wallet balance for charging payments. These payment providers have their own terms and privacy policies which apply to your transactions.

Refunds are provided when sessions are cancelled before charging begins, chargers malfunction during sessions, system errors cause double charging, or other errors occur on our part. Refunds are not provided when sessions are completed as requested, users cancel after charging begins, or users change their minds after completing sessions.

To dispute a charge, contact support@treviaev.in within thirty days of the transaction. Provide your booking ID and any supporting evidence including screenshots. We investigate within seven days and process refunds if charges were in error. If you dispute with your bank instead of contacting us first, you will incur a chargebacks fee of five hundred rupees.

Section 4.7: Limitation of Liability

Trevia is not responsible for charger malfunctions, unavailability, slow charging speeds, vehicle incompatibility issues, electrical damage to vehicles, or charger pricing decisions made by operators. We are not responsible for third-party payment processor issues, Google or Apple account problems, internet service provider failures, or vehicle manufacturer defects.

We do not accept liability for accidents or injuries at charger locations, vehicle damage or property loss, parking lot incidents, weather-related damage, or theft and vandalism. We are not liable for data loss if you fail to maintain backups, service outages except those caused by our negligence, third-party hacking of your account, or events beyond our control including natural disasters.

We disclaim liability for indirect or consequential damages including lost profits, lost business opportunities, lost time or convenience, emotional distress, or punitive damages.

Our maximum total liability in any claim is limited to the amount you paid Trevia in the twelve months preceding the claim, or zero rupees if you have not paid anything. Exceptions to this limitation include gross negligence or willful misconduct by us, fraud or intentional deception, violation of your fundamental rights, and personal injury we directly caused.

PART FIVE: GENERAL PROVISIONS

Section 5.1: Changes and Updates to Terms

Trevia may update these terms periodically. Non-material changes including clarifications and corrections are effective immediately. Material changes including new data collection practices or new service features require thirty days' notice before becoming effective.

We notify users of material changes through in-app notifications, email communications to your registered address, and website banners with updated dates. For major changes, we provide explicit notice and request acknowledgment before you can continue using services.

You can accept new terms by continuing to use Trevia after the thirty-day notice period. You can reject new terms by deleting your account within thirty days. If you do not agree with updated terms, you should stop using services rather than accept terms you disagree with.

Section 5.2: Contact Information and Grievance Resolution

For customer support questions or technical issues, contact support@treviaev.in. We respond to support inquiries within twenty-four to forty-eight hours.

For privacy-related requests, contact privacy@treviaev.in. Send requests with clear subject lines including "Data Access Request," "Data Deletion Request," or "Unsubscribe Request." We respond within thirty days for statutory privacy requests.

Section 5.3: Governing Law and Jurisdiction

This agreement is governed by Indian law without regard to conflict of law principles. The laws of India apply to all disputes and claims. Telangana state law governs where applicable. The Information Technology Act, 2000, Digital Personal Data Protection Act (DPDPA), 2023, and Consumer Protection Act, 2019 apply.

The exclusive jurisdiction for disputes is the courts of Hyderabad, Telangana. District courts in Hyderabad hear cases up to specific amounts. The High Court of Telangana hears appeals. The Supreme Court of India hears final appeals. Both parties consent to Hyderabad jurisdiction exclusively.

Section 5.4: Entire Agreement

This complete document constitutes the entire agreement between you and Trevia regarding the use of services. It replaces all previous communications, agreements, and understandings whether written or oral. If any part of this agreement conflicts with another policy or document, this agreement controls.

No verbal modifications or informal agreements alter these terms. Only written amendments signed by authorized representatives of both parties can modify this agreement. Your acceptance of new versions when we update terms does not affect prior versions for disputes arising under earlier versions.
